English Arbitration Law and Cross Border Commercial Dispute Resolution: Lessons for Commonwealth Jurisdictions

    This article explores English arbitration law’s contribution to resolving cross-border commercial disputes and the lessons it may offer Commonwealth jurisdictions. It focuses on the Arbitration Act 1996, as amended by the Arbitration Act 2025, the New York Convention, the UNCITRAL Model Law, and the roles of the Chartered Institute of Arbitrators and the London Court of International Arbitration. The article argues that England is an attractive arbitration forum because of party autonomy, minimal court interference, fair procedure, enforceability, court and law society expertise, and institutional support. But without adjustment, the English model is not one to copy. Commonwealth jurisdictions vary in court capacity, legal culture, arbitral institutions, enforcement practice, legal cost structure, and legal service expertise. The article therefore contributes to adaptation, not transplantation. It concludes that Commonwealth reform should focus on modern legislation, judicial training, arbitral capacity, enforceable awards, technology, diversity, and credible institutions.
